    I am an attorney in Phoenix, Arizona. I have been practicing for nearly 30 years. My practice has always been in litigation. Early on, it had more involvement with products liability and medical negligence. This allowed me to see firsthand the impact that these events can have on children and families. In 2001, my legal assistant’s younger sister had an adverse reaction to a mandated vaccine. I had never heard of the Vaccine Injury Compensation Program, but quickly discovered that it is an exclusive remedy that must be first pursued for a vaccine-related injury. I represented her in her claim in the VICP. We were successful in her case, and the Court of Federal Claims added me to their referral list of attorneys handling vaccine-related cases. Since that time, my practice has expanded, now to the point that my Firm is one of a handful of Firms in the country that specialize in vaccine injury litigation. Downing, Allison & Jorgenson is now one of the preeminent Firms in the Country, and we are referred to as the National Vaccine Injury Lawyers. Vaccine injury cases are all my Firm handles.

    As part of this almost 30-year endeavor, I have seen the problems with vaccination, ranging from the initial regulatory approval and licensure process, how clinical studies are performed and accepted, post-licensure safety studies and their flaws, and ultimately what happens to a child and family when someone is injured by a mandated vaccination. Certainly, all of these issues are problematic, and this system, from the initial approval process to attempts at getting compensation for victims of vaccine injury, is broken. Particularly evident are the issues with the VICP. What started out as a way to protect manufacturers from direct liability and service victims of vaccine injuries has devolved into a massively litigation-driven process, where families are vilified as “anti-vaxxers” for the suggestion that vaccination may have been a contributing factor to harm and the VICP holds these victims to a far higher burdens of proof than was ever intended. At this point, it is nearly impossible for a vaccine-injured individual or family to recover in the VICP and they have little recourse against the manufacturers.

    I have worked with Bobby Kennedy and CHD over the years, particularly in the area of vaccine injuries. The chance to fix this broken system and make meaningful changes in this regard is an opportunity too important to families and children to pass up.
